Below you'll find our warranty. Standard legal stuff mostly. The important thing is we have your back. If we put a sub-standard product out there, we'll replace (or fix, but generally replace) it, in the country you got it from. Except if you break it jibbing or something. So, use it, enjoy it, don't sue us if you hurt someone using it (that's your fault), and we'll be sweet. HERESY SNOW SNOWBOARD WARRANTY Heresy Snowboarding (a Division of Heresy Snow) warrants all snowboards sold by Heresy to be free of defects in material or workmanship for a period of one (1) year from the date of purchase. If a product is found to be defective by Heresy, in its sole discretion, Heresy's only responsibility shall be limited to repair or replacement of the defective product - in the country of purchase. Heresy will not be responsible for any costs, losses, or damages incurred as a result of loss or use of product. Use of our boards implies release from any liability arising from your use of our boards. This warranty is subject to the following limitations in addition to any imposed by virtue of applicable law. 1. The warranty applies only to Heresy products purchased from authorised Heresy representatives (sales reps), or from the online store and is valid for the ORIGINAL PURCHASER ONLY. 2. All products returned to Heresy for warranty inspection must receive prior return authorisation which can be given over the phone/email (after high res photos of the defect are provided by you). You need to ship products freight prepaid and insured. Heresy assumes no responsibility for products during shipment from the customer to our office. Shipping charges are NOT refundable. 3. Excluded from coverage under this warranty are the following (but not limited to): * Damage caused by HANDRAILS. * Damage caused by misuse, abuse or neglect (rock bonking etc). * Damage caused by improper mounting or adjustment of the bindings. * Damage caused from chairlift breakage. * Normal wear and tear. * Damage caused by anything other than defects in material or workmanship. * Damage caused by use of solvents, adhesives or LOC-TITE®. * Damage to Heresy products caused by non-Heresy products. * Any and all claims for consequential or incidental damages. 4. All coverage under this warranty is void if any modification, change or alteration has been made to the product that is not specifically authorised in writing by Heresy. 5. Repaired or replaced products are covered for the remainder of the warranty only. 6. All warranty claims must be accompanied by the original purchase receipt from an authorised Heresy Rep (or the online store). Invoice or charge receipt must clearly identify the dealer. 7. Heresy product is not covered by any verbal warranty. 8. Territory is taken to mean Country, State, Province, Canton, Prefecture, Territory, District or otherwise whereby a Trade Practices Act exists. 9. Heresy seeks at ALL times to act within the bounds of all Trade Practice Acts - if you believe we have acted outside an Act, please contact us immediately for rectification (we take our obligations to fair trading VERY seriously). 10. ROCK DAMAGE AND ANY OTHER IMPACT RELATED DAMAGE IS NOT COVERED UNDER THIS WARRANTY (INCLUDING HANDRAILS) . ALL WARRANTIES IMPLIED BY APPLICABLE TERRITORY (Country, State, Province etc) LAW, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY LIMITED TO THE DURATION OF THE WRITTEN WARRANTY. SOME DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. WITH THE EXCEPTION OF ANY WARRANTIES IMPLIED BY PROVINCIAL LAW AS HEREBY LIMITED, THE FOREGOING EXPRESS LIMITED WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, GUARANTEES, AGREEMENTS AND SIMILAR OBLIGATIONS OF MANUFACTURER OR SELLER. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS WHICH VARY FROM TERRITORY TO TERRITORY. WARNING: The use of this product alone, or in conjunction with any bindings, which do not contain quick release mechanism, requires skill and the exercise of caution. Failure to exercise caution in the use of these products could result in serious bodily injury or even death. Adults should properly supervise children using these products. Due to the nature of these products, the seller, distributor, and manufacturer of these products assumes no responsibility for damage or injury, which may be caused by accident, negligence, or otherwise. By using these products, you release us from all legal liability, civil, criminal or financial recourse or obligation arising from your misuse, negligence or accidents resulting in death, injury or damage to property.
